These Terms of Service (“Terms”) govern your use of shadeformhome.com and any purchase from Shadeform. Shadeform is operated by LILY KNOCHEL HJ INC, 223 E Main St, Evans City, PA 16033, United States (“Shadeform,” “we,” “us,” or “our”).
By visiting the site, creating an account, or placing an order, you agree to these Terms, our Privacy Policy, and our Return & Refund Policy. If you do not agree, do not use the site.
1. Eligibility
You must be at least 18 years old and able to form a binding contract under U.S. law. You may use the site only for lawful personal or household purchases in the United States.
2. Our store
We sell table lamps and related home lighting for indoor use. Product titles, descriptions, measurements, colors, and photos are provided as accurately as we reasonably can. Colors can look different on different screens. Minor variations in wood grain, metal finish, glass, or fabric are normal and are not defects.
We may correct errors, update product information, limit quantities, and discontinue products at any time.
3. Accounts
If you create an account, you are responsible for keeping the login confidential and for activity under the account. Email service@shadeformhome.com if you think the account has been used without permission.
4. Orders and cutoff time
An order is an offer to buy. We may accept or decline an order for reasons including stock, pricing errors, suspected fraud, or inability to ship to the address.
Our daily order cutoff is 5:00 p.m. U.S. Eastern Time on business days (Monday–Friday, excluding U.S. federal holidays).
- Orders placed before 5:00 p.m. ET on a business day are prepared for shipment that business day when possible.
- Orders placed after 5:00 p.m. ET, or on a weekend or holiday, are processed the next business day.
A contract is formed when we send an order confirmation and charge or authorize payment. We may cancel before shipment if we cannot fulfill the order. If we cancel, we refund the amount charged.
5. Prices and taxes
Prices are in U.S. dollars and may change before you place an order. The price charged is the price shown at checkout, plus applicable shipping and sales tax.
We collect sales tax where required. Tax amounts shown at checkout are estimates until the order is completed.
If a price is obviously wrong (for example, $1.00 instead of $34.99), we may cancel the order and refund you.
6. Payment
We accept the payment methods offered at checkout through Shopify and its payment partners. You represent that you are authorized to use the selected method.
Payment must be completed before we ship. We may use fraud checks. If a payment is reversed or charged back after shipment, you remain responsible for the order amount and our reasonable collection costs.
7. Shipping
We ship only to addresses in the United States. We do not ship to P.O. boxes if the carrier we use cannot deliver there.
Shipping rates, methods, and estimated delivery dates are shown at checkout. Estimates are not guarantees. Weather, carrier delays, incorrect addresses, and events outside our control can add time.
You are responsible for providing a complete, deliverable address and for any duties or fees that a carrier may assess after delivery attempts. Risk of loss passes to you when the carrier delivers the package to the address you provided, or when the carrier first marks the package delivered or available at a pickup location.
If a package is returned to us because of a wrong address, refusal, or failure to pick it up, we may charge you the cost of reshipping or process a refund minus outbound shipping and any return-to-sender cost.
8. Use of the products
Lamps are indoor electrical products. Follow the product description and any included instructions. Do not use a bulb above the stated wattage. Do not use the lamp outdoors or in a wet location unless the listing expressly says it is rated for that use.
You are responsible for safe assembly, placement, and use. We are not responsible for damage caused by misuse, modification, incompatible bulbs, or installation that does not follow the instructions.
9. Returns and refunds
Returns, exchanges, cancellations, and refunds are governed by our Return & Refund Policy, which is part of these Terms. The 30-day return window, condition rules, who pays return shipping, and refund timing are set out in that policy.
10. Promotions
Coupon codes, discounts, and free-shipping offers may have expiration dates, minimum-order amounts, and product exclusions. We may cancel an offer if it is used in a way we consider abusive or in error.
11. Intellectual property
The Shadeform name, shadeformhome.com, logos, product photos, descriptions, and site design are owned by us or our licensors. You may not copy, scrape, resell, or use them for a competing store without written permission.
Product names and images of third-party services mentioned on the site remain the property of their owners.
12. Acceptable use
You may not:
- Use the site for any unlawful purpose
- Attempt to break, overload, or probe the site
- Use bots to place orders, scrape content, or create fake accounts
- Submit false checkout information
- Interfere with other customers or our operations
We may refuse service, close accounts, or cancel orders if we reasonably believe these rules were broken.
13. Reviews and messages
If you submit a review, photo, or message, you grant us a non-exclusive right to use it on the site and in our marketing. Do not submit content that is false, infringing, or unlawful. We may remove content at our discretion.
14. Third-party services
Checkout, payments, shipping labels, analytics, and advertising may be provided by Shopify, payment processors, carriers, and Google or similar providers. Their terms and privacy policies apply to their services.
15. Disclaimer
The site and products are provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the site will be uninterrupted, error-free, or free of harmful code, or that product colors on your screen will exactly match the physical item.
Some states do not allow certain warranty disclaimers. In those states, the disclaimer applies only to the extent permitted.
16. Limitation of liability
To the fullest extent permitted by law, LILY KNOCHEL HJ INC, Shadeform, and our officers, employees, and contractors are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, or business interruption, arising out of the site or any product.
Our total liability for any claim related to an order is limited to the amount you paid for that order.
This limit does not apply to liability that cannot be limited under applicable law, including liability for our own gross negligence or willful misconduct where such a limit is prohibited.
17. Indemnity
You agree to defend and indemnify Shadeform and LILY KNOCHEL HJ INC against claims, damages, and reasonable legal fees arising from your misuse of the site or products, your violation of these Terms, or your violation of another person’s rights.
18. Governing law and disputes
These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to conflict-of-law rules.
If a dispute cannot be resolved by contacting service@shadeformhome.com, the state or federal courts located in Pennsylvania shall have exclusive jurisdiction, unless applicable law requires otherwise for consumers.
You and we each waive the right to participate in a class action to the extent such a waiver is permitted by law.
19. Changes
We may update these Terms at any time. The “Last updated” date will change when we do. Continued use of the site after an update means you accept the revised Terms. For material changes that affect an existing order, the Terms in effect when you placed that order will apply to that order.
